This Privacy Policy represents a part of the Member Agreement and was created by the Site to illustrate our procedures on disclosures and on protection of private information. Described herein are details regarding the gathering of information, instructions on the procedures to take to opt-out of receiving notifications other than notifications required for account maintenance from the Site.

Minors

In-Charge offers content focused toward Members who are adults at least eighteen (18) years of age (21-years old where 18 is not the age of majority) who also own an authorized credit card. In-Charge requires that all Members and Models be at least eighteen (18) years old (21-years old where 18 is not the age of majority). Portions of the Site available to individuals, such as the Site home page and Model profile pages have no intentions of gathering or distributing personal information such as name, address, email address, or telephone number from individuals under eighteen (18) years of age (21-years old where 18 is not the age of majority). Persons under the age of eighteen (18) years of age (21-years old where 18 is not the age of majority) should not visit the Site or submit information to the Site as minors are not eligible to use In-Charge. Therefore, we request that a parent, guardian, or legal custodian of any minor who has provided In-Charge with personally-identifiable information contact us via the email listed at the bottom of this Policy immediately.

Collection of Information

In-Charge may use a Member or Model’s IP address to assist in the diagnosis of problems related to the Site, our databases, or our servers. An IP address can tell the location and service provider of an individual as well as which parts of the website an Individual is accessing. In-Charge does not publicly list IP addresses or use IP addresses to display personally identifiable information. A Member or Model’s session may be tracked but anonymity will remain during the session. In-Charge tracks IP addresses for purposes of liability protection, fraud prevention, and if warranted to release IP addresses to legal authorities or government agencies. The Site primarily collects personally identifiable information from individuals to provide all Members and Models with a more effective, efficient, and rewarding experience while using the features and services of the Site. In-Charge may require Members and Models to provide the Site with contact information as well as personal information such as legal names, working names, email addresses, phone numbers, banking account information, zip codes, and age. Additionally, for Models we may require information such as but not limited to mailing address, Social Security Number, Federal Tax ID number, and bank information. The Site collects information from Models to comply with federal, state, and tax laws. In-Charge uses a third party to process credit cards for billing purposes. This third party may opt to store or maintain the data provided by Members to create a more efficient experience for site Members. Additionally, you should be aware that if you use your legal name as your Member name or Model name that this information will be visible to all individuals who visit the Site.  The Site may also utilize features such as but not limited to in-site emailing, forums, or chat rooms. Models may also have the option of providing additional information which will be display publicly on the Model’s profile page which will be made public to all individuals viewing the website. If a Member or Model opts to use the features of the site such as but not limited to in-site emailing, forums, or chat rooms to post personally identifiable information, realize that the information posted may be read, collected, maintained, copied, or used by others. The Site and In-Charge are not responsible for the distribution of personally identifiable information which a Member or Model may provide in these forums.  In-Charge uses contact information to send Members and Models the required notifications regarding news about the Site, news and updates about In-Charge, and information needed to maintain an individual’s store or membership account. Members have the ability to opt-out of receiving notifications from In-Charge (other than information required for account maintenance and administrative details). In-Charge uses financial information to pay out Models and to bill Members for the use of services rendered. The Site may request additional information from Members and Models via promotional programs, special offers, or marketing surveys. Participation regarding the call for additional information is voluntary and the Members or Models maintain the choice to not complete the requests for additional information. The information collected will be used to further develop the sites aesthetic look, user interface, user experience, quality of services offered, and functions of the site to better meet the needs of Members and Models. Furthermore, In-Charge may utilize information we maintain about a Member’s purchases and returns as well as a Model’s sales and returns in regards to previous site activities to resolve disputes, identify liabilities, create solutions to problems, enforce Member Agreements, or to terminate a Member or Model’s account.  In-Charge may contain links to other websites. In-Charge and the Site are not responsible for the practices regarding privacy or the content of such third party websites.

Disclosure of Information

Unless stated within this policy, In-Charge or the Site does not trade, share, sell, rent, or distribute personal information about Members or Models to any third parties except for financial institutions or third party payment processors who streamline the payment processes regarding transactions or in cases required by legislative law. In-Charge also reserves the right to share personal information with the appropriate authorities and to any bank associated with a Member or Model account in order to prevent fraud, deter liabilities, diminish illegal activities, or to prevent harm to any persons when the Site is morally obligated to do so by law requirements. In the event of government requests regarding disclosure of information about Members or Models, the Site has the ability to comply with all government requests and turn over any and all records. Additionally, when In-Charge is required to do so because of court order regarding disputes involving Members or Models, reasonably believes release of information will alleviate liability, or to enforce the In-Charge’s rights, all Members or Models allow In-Charge to release the necessary information.  If In-Charge or the Site goes through a business transition such as but not limited to a merger, acquisition, or sale of assets related to the company, Member’s and Model’s personal information will be part of the assets transferred to the new business entity. If after the business transition, the personally identifiable information will be used or maintained differently than outlined in this policy or at the time of the collection of information, then Members and Models will be given ample time to decide whether or not they agree to the new changes in policy.

Third-Parties

The Site may contain links to other websites. Take note, In-Charge is not responsible for content or privacy practices related to third-party website. By clicking any third-party links, individuals run the risk of potentially having information collected by third-party advertising, marketing, or service companies and / or providers. Third-parties could potentially collect information in regards to the type of internet browser used by an individual, the domain name of the site or location on our site which led to the third-party website and in regards to which operating system an individual chooses to use. A third-party may even use cookies during the length of an individual’s visit to a website. This allows them to determine how far an individual has progressed into the website and any actions taken by the individual on the website. A third-party is only allowed to use the information collected for general reporting as described above.

Monitoring Content

The Site reserves the right to reasonable monitor, if possible, all content submitted and exchanges between members on the Site.  To clarify, this includes but is not limited to audio, pictures, videos, or information displayed and accessible to Members from Models as well as communications between Members and Models with each other via chat, email, or usages of any forums provided by In-Charge. The Site can remove or advise Models to remove any material / content which violates the member agreement, potentially creates liability, infringes this privacy policy, or is deemed unlawful.  In-Charge may release information if the Site has just cause to do so in regards to compliance with laws, legal requests, regulations, or government legislation to alleviate liabilities and to safeguard users.

Do Not Contact

As stated above, the Site may contact Members and Models for additional information or may send out emails regarding promotional content or site news. Users can choose to opt-out of these emails and be placed on a do-not-contact list. In-Charge still will send out emails required for account maintenance or for important notifications.

Notification of Changes to Our Privacy Policy

We will notify users in a timely fashion as to any material changes in our privacy policy or other terms of service related to the Site.  We will either display these changes publically on the main page of the website or through email to all users regardless of whether those Members or Models are on the do-no-contact list.
